Indicating the incoterms in a sales contract also helps to minimize disputes and litigation. Every 10 years, the ICC publishes an update of the Incoterms. In 2020, the expected revisions include the removal of Ex-Works (EXW) and Delivered Duty Paid (DDP) among others. Read more about Incoterms 2020 rules here. DPU is the only Incoterms rule that requires the seller to unload goods at destination. The seller should therefore ensure that it is in a position to organise unloading at the named place.

The DAP Incoterm, or “Delivered at Place”, replaces the now outdated DDU Incoterm, or Delivery Duty Unpaid, which appeared in the previous Incoterms edition, Incoterms 2000.

Incoterms® 2010 rules came into force on Januray 1, 2011. The delivery terms DAF, DES, DEQ and DDU have been replaced by new delivery terms DAP and DAT. Incoterms® are the rules frequently used worldwide in international and domestic contracts, illustrating responsibilities between buyer and seller for costs and risk, as well as Shipment Value Protection.

This time, let’s look at DAP/ DPU/ DDP of Incoterms 2020 Group D. Incoterms rules have been revised in 2000, 2010, and 2020 to ensure that the trade terms are clearer. However, the terms DDU and DAT which are already abolished are still being used in commercial practices.

Should the parties intend the seller not to bear the risk and cost of unloading, the DPU rule should be avoided and DAP should be used instead.

[Depracated Incoterm] DDU was an international commerce term where the seller delivers the goods as soon as made available. DDU is no longer used in the Incoterms® 2020 Rules.
